Your HFPOA board thanks our neighbors who attended the special meeting. Based on your input and your Board’s commitment to our neighborhood:

  1. One warning will be given for compliance violations prior to fines being issued; no warnings will be given for any pool-related or architectural violations.
  2. Effective date for new noncompliance fine schedule is moved to December 1, 2023, to ensure everyone is properly notified. We will still be mailing this to every resident regarding the new fine schedule as planned.
  3. Sections of the Bill of Assurance will be posted on the POA website and Facebook page with simple explanations of that section so it is transparent and easy to understand for everyone.
  4. The Bill of Assurance requires updating for legal purposes (removing the developer and his voting capability). The board intends to make the Bill of Assurance easier to understand including POA compliance violations. Parking of trailers/boats/RV’s, basketball goals, street parking, and trash cans will be addressed. Your input of these matters would be appreciated.

On a less positive note: There are several neighbors who are trying to remove the POA board (and potentially the POA) because of enforcing the Bill of Assurance. Over 100 warnings/notifications were delivered to neighbors this year. 11 neighbors received fines. Your POA board is determined to keep the Heritage Farm neighborhood as a desired place to live in Benton. Support your proactive POA board. It has positive ideas, is protecting your property values, and has your and our best interest in mind.

POA Dues – 2023/2024 Invoices have been mailed out https://heritagefarmpoa.com/poa-dues-are-due-now/ Wed, 10 May 2023 13:44:43 +0000 http://heritagefarmpoa.com/?p=1048 POA Dues are due on June 1, 2023. Dues were increased 5% and are now $241.50 for the year. The POA Board voted for this increase to cover the numerous increases we are faced with. As you are aware, utilities have increased along with nearly all goods and services. Also, please update all your information on the form that was included with the invoices. Heritage Farm has 422 homes making it necessary for us to update all contact information. It’s mandatory for all landlords to promptly register their rental property with the POA treasurer. Renters must also be registered with the POA treasurer upon anticipated move in as well as the date a renter moves out! If for some reason you have not received your POA dues invoice for 23/24, please contact the treasurer.

EFFECTIVE FEBRUARY 1, 2023

● $250 immediate fine for failure to seek and secure prior HFPOA
Architectural Control Committee authorization before making changes to
an existing structure or adding any additional structure including inground
pool, out building, solar panels, unapproved fencing or roofing, etc. All
detailed plans must be submitted to this committee and approved prior to
any delivery and before installation commences. This fine does NOT give
approval or authorization and further fines will continue if not approved
after the fact until reinstated to previous state to bring back into approved
compliance standing.
● $50 after non-compliance notification. Motor home, boat, trailer, etc
extending beyond the front of the home. Minimal allowance for cleaning of
boat or camper is allowed with prior notification to compliance committee.
Must contact compliance for any other questionable situation for guidance!
Fine increases to an additional $100 for each subsequent week until
violation is corrected.
● $200 immediate fine for rubbish, trash, equipment, toys, etc visible from the
road making yard look unsightly. Additional $200 fine each subsequent
week until violation is corrected.
● $200 immediate fine for above ground swimming pool. $100 additional fine
incurred each week thereafter until the pool is removed.
● $25 per day for motor vehicles, trailers, etc parked on the street, sidewalk,
or on the front lawn. Temporary guests (1 week maximum) are the ONLY
exception!
● $50 per day after non-compliance notification for any non operational or
unlicensed vehicle sitting in front of the home.
● $100 per week after non-compliance notification for overgrown, or unkept
lawn, floral beds, shrubs or bushes.
(Weeds or grass over 10 inches tall.) Additional $100 fine each subsequent
week until violation is corrected.
● $250 for failure to register a rental property with the HFPOA Treasurer
within 1 week of establishing a rental Property.
● $200 for failure to provide the HFPOA Treasurer all names and contact
information for renters moving in or out immediately after a verbal or
written rental agreement or vacate notice.
● Renters will also have pool access revoked and incur fines for ALL
violations.
● $25.00 administrative fee for not providing the HFPOA Treasurer accurate
updated correspondence information for billing purposes.
● $50 failure to securely close the pool gate when entering and exiting.
(Automatic suspension of pool key fob for 1 month)

● $200 failure to secure and use an approved swim diaper for all babies and
toddlers in and around the pool that results in the need to shock and close
the pool. *Also applies to your guests.
● Automatic suspension of key fob for not registering and enclosing $4 per
pool guest through the slot on the office door prior to their pool entry. If
you or your family member lets them in the gate, they are your
responsibility and you must pay for them!
● $250 for climbing the fence or forcing the pool gate open or any other
tampering with HFPOA equipment or structure. (Automatic suspension of
key fob for entire season)
● Automatic suspension of key fob all season for loaning your key fob or
opening entrance gate for anyone not registered at your home except your
paid guests that are accompanied by you!
● $50 for failing to pick up all trash and secure in provided waste receptacles
prior to departing pool or pavilion area. (Fine doubles for each additional
occurrence.)
Automatic suspension of key fob up to the entire pool season for any
violation of pool rules including children under 15 in pool area without the
presence of the required adult supervisor!

The HFPOA will file liens for unpaid fees and administrative charges will be added to
each lien. Fines are due and payable within 30 days of notification. After 30 days a $25
administrative fee will be added monthly to all unpaid fines. In addition, all fines for non
compliance will result in the key fob being inactive and will remain inactive until all fees
and fines are verified paid in full by the treasurer!
RENTERS: All renters must now pay $250 per year for pool use per registered rental
family as verified by the landlord. Only verified Tenants will be allowed to register for this
pool usage. Key fobs will be shut off if renter has any violation fines that are unpaid or
for any indicated serious violations. Refunds will not be issued!
